Informed consent is considered by many to be a moral imperative in medical research. However, it is increasingly acknowledged that in many actual instances of consent to participation in medical research, participants do not employ the provided information in their decision to consent, but rather consent based on the trust they hold in the researcher or research enterprise. In this article we explore whether trust-based consent is morally inferior to information-based consent. We analyse the moral values essential to valid consent (...) – autonomy, voluntariness, non-manipulation, and non-exploitation – and assess whether these values are less protected and promoted by consent based on trust than they are by consent based on information. We find that this is not the case, and thus conclude that trust-based consent if not morally inferior to information-based consent. (shrink)

The lifetime equality view has recently been met with the objection that it does not rule out simultaneous inequality: two persons may lead equally good lives on the whole and yet there may at any time be great differences in their level of well-being. And simultaneous inequality, it is held, ought to be a concern of egalitarians. The paper discusses this and related objections to the lifetime equality view. It is argued that rather than leading to a revision of the (...) lifetime equality view, these objections, if taken seriously, should make us account for our egalitarian concerns in terms of the priority view rather than the equality view. The priority view claims that there is a greater moral value to benefiting the worse off. Several versions of the priority view are also distinguished. (shrink)

In an influential article, Simon C. May forcefully argued that, properly understood, there can never be principled reasons for moral compromise. While there may be pragmatic reasons for compromising that involve, for instance, concern for political expediency or for stability, there are properly speaking no principled reasons to compromise. My aim in the article is to show how principled moral compromise in the context of moral disagreements over policy options is possible. I argue that when we disagree, principled reasons favoring (...) compromises or compromising can assume a more significant part of what makes a position all things considered best, and in this way disagreement can ground moral compromise. What I call hegemonism holds that a satisfactory moral theory must in a fairly direct way guide action. This, the hegemonist believes, provides a constraint on moral theorizing. We should not accept moral theories which cannot in the proper sense guide us. There are two alternatives to hegemonism. One is motivational indirection, which is the idea that while agents remain motivated by a moral theory, they may be only indirectly motivated. The other is non-hegemonism, which holds that a correct moral (...) theory need not in any direct or indirect sense guide or motivate actions. In the main part of the paper I discuss widely endorsed objections to motivational indirection and nonhegemonism, and I argue that these objections all fail. Hence, motivational indirection and non-hegemonism remain viable conceptions of moral theory. (shrink)

This paper sketches a general account of how to respond in an epistemically rational way to moral disagreement. Roughly, the account states that when two parties, A and B, disagree as to whether p, A says p while B says not-p, this is higher-order evidence that A has made a cognitive error on the first-order level of reasoning in coming to believe that p. If such higher-order evidence is not defeated, then one rationally ought to reduce one’s confidence with respect (...) to the proposition in question. We term this the higher-order evidence account, and present it as a superior to what we might call standard conciliationism, which holds that when agents A and B disagree about p, and are epistemic peers, they should both suspend judgement about p or adjust their confidence towards the mean of A and B’s prior credences in p. Many have suspected that standard conciliationism is implausible and may have skeptical implications. After presenting the HOE account, we put it to work by applying it to a range of cases of moral disagreement, including those that have feature in recent debates assuming standard conciliationism. We show that the HOE account support reasonable, non-skeptical verdicts in a range of cases. Suppose we have a persistent disagreement about a particular set of policy options, not because of an underlying moral disagreement, or a mere conflict of interest, but rather because we disagree about a crucial non-normative factual assumption underlying the justification of the policy choices. The main question in the paper is what political legitimacy requires in such cases, or indeed whether there are defensible answers to that question. The problem of political legitimacy in fact-dependent policy disagreements has received almost no (...) attention in political philosophy, which has focused mostly on value disagreements and proposed theories of legitimate coercive legislation in valuedependent disagreements. The paper presents an argument showing that under certain plausible assumptions regarding legitimacy, there are serious difficulties in identifying legitimate choices in fact-dependent policy disagreements. This may be unsurprising to political philosophers preoccupied with value-based disagreements, perhaps because it has been assumed that legitimacy-related concerns are irrelevant to fact-dependent policy disagreements. The paper argues that this response is premature. If we should care about legitimacy et al.l, then it is by no means clear why we should ignore issues of legitimacy in policy-disputes that depend on factual disagreements. The paper ends by defining a set of possibilities that merit further exploration in search of a theory of legitimacy in fact-dependent policy disagreements. (shrink)

Recently Robert B. Talisse has put forth a socio-epistemic justification of liberal democracy that he believes qualifies as a public justification in that it purportedly can be endorsed by all reasonable individuals. In avoiding narrow restraints on reasonableness, Talisse argues that he has in fact proposed a justification that crosses the boundaries of a wide range of religious, philosophical and moral worldviews and in this way the justification is sufficiently pluralistic to overcome the challenges of reasonable pluralism familiar from Rawls. The fascinating argument that Talisse furthers is that when cognitively functional individuals reflect on some of their most basic epistemic commitments they will come to see that, in virtue of these commitments, they are also committed to endorsing key liberal democratic institutions. We argue that the socio-epistemic justification can be reasonably rejected on its own terms and thus fails as a public justification approach. This point is made by illustrating the significance of deep epistemic disagreements in liberal democracies. (shrink)

The paper addresses the possibility of providing a meta-justification of what appears to be crucial epistemic desiderata involved in the method of reflective equilibrium. I argue that although the method of reflective equilibrium appears to be widely in use in moral theorising, the prospects of providing a meta-justification of crucial epistemic desiderata are rather bleak. Nor is the requirement that a meta-justification be provided obviously misguided. In addition, I briefly note some of the implications of these results for our use (...) of the method of reflective equilibrium and for the best interpretation of the method. (shrink)

CRISPR is currently viewed as the central tool for future gene therapy. Yet, many prominent scientists and bioethicists have expressed ethical concerns around CRISPR gene therapy. This paper provides a critical review of concerns about CRISPR gene therapy as expressed in the mainstream academic literature, paired with replies also generally found in that literature. The expressed concerns can be categorised into three types depending on whether they stress risk/benefit ratio, autonomy and informed consent, or concerns related to various aspects of (...) justice. In the reviewed literature, we found no intrinsic objections to CRISPR gene therapy, even though many such objections were present in discussions of gene editing in the 1990s. The paper then proposes a brief outline for a practically applicable moral framework for public decision-making about CRISPR gene therapy and suggests how such a framework might be supported. We also suggest that this framework should govern public engagement about CRISPR gene therapy in order to reduce the risk that we make decisions about CRISPR gene therapy based on misperceptions, inflated views of risk, or unreasonable moral or religious views. Robert Audi's ethical intuitionism (Audi, 1997, 1998) deals effectively with standard epistemological problems facing the intuitionist. This is primarily because the notion of self-evidence employed by Audi commits to very little. Importantly, according to Audi we might understand a self-evident moral proposition and yet not believe it, and we might accept a self-evident proposition because it is self-evident, and yet fail to see that it is self-evident. I argue that these and similar features give rise to certain challenges to Audi's (...) intuitionism. It becomes harder to argue that there are any self-evident propositions at all, or more than just a few such propositions. It is questionable whether all moral propositions that we take an interest in are evidentially connected to self-evident propositions. It is difficult to understand what could guide the sort conceptual revision that is likely to take place in our moral theorising. It is hard to account for the epistemic value of the sort of systematicity usually praised in moral theorising. Finally, it is difficult to see what difference the truth of Audi's ethical intuitionism would make to the way in which we (fail to) handle moral disagreement. (shrink)

The aim of this chapter is to examine how diversity benefits deliberation, information exchange and other socio‐epistemic practices associated with free speech. We separate five distinct dimensions of diversity, and discuss a variety of distinct mechanisms by which various forms of diversity may be thought to have epistemically valuable outcomes. We relate these results to the moral justification of free speech. Finally, we characterise a collective action problem concerning the compliance with truth‐conducive norms of deliberation, and suggest what may solve (...) this problem. (shrink)

The totality of the world may be interpreted in terms of the homo noumenon, or in terms of a totality of values, in terms of feeling or as the historical stream of experience. The interrelationship between the various aspects of reality is misconstrued by humanism when the modal (...) laws of the world are absolutized, and a single aspect is made the basic denominator of reality. The neo-Augustinian philosophy of Dooyeweerd recognizes the priority of faith and would unmask the alleged neutrality of theoretical reason as a dogma concealing the religious foundations of theoretical thought. The Archimedean point of Dooyeweerd's philosophy is not cogito ergo sum, nor vivo in [luxu continuo, etiam cogitans, but it is rather: Ego, in Christo regeneratus, etiam cogitans ex Christo vivo. The heart in its Biblical sense is the religious root and center of human existence, the center in which our temporal functions find their religious concentration and consummation of meaning. The Christian philosopher finds the ultimate origin of the world in God's sovereign and creative will, out of which originate all laws, and all things which are subject to law. The Christian philosopher finds the coherence of the modal diversity of the cosmos in a divine world order. The unity of the world is not a construction of philosophical thought, but is rather an enduring effect of God's sovereign power, so that each mode, each aspect of the cosmos is under divine law. Every aspect of the world is a sphere of law, sovereign under God in its own domain. God's laws constitute the universal valid determination and limitation of the individual things subject to them. Consequently, the Christian philosopher cannot hold to a theoretical conception of reality which is emancipated from the Biblical motive of creation, for all such conceptions are at least partially dominated by apostate religious motives. Nash does not attempt to refute Dooyeweerd's main thesis concerning the impossibility of a religiously neutral philosophy; however, his critical remarks do point out that more argumentation is needed in defense of that thesis, and that the introduction of a new terminology, shifts in the meaning of traditional terms, as well as vagueness and ambiguity, necessitate further elaboration on the part of Dooyeweerd and the members of his School. Nash's work successfully accomplishes a two-fold purpose: it calls attention to an important development within the Augustinian tradition of philosophy, and it raises issues which cannot be ignored by members of Dooyeweerd's own school as well as by philosophers who are self-critical of their own presuppositions. Nash's book deserves careful attention and it is to be hoped that it will direct the serious reader to a study of Dooyeweerd's own works and that it will stimulate others to take part in the critical study of a system of thought which "gives important and exciting direction to present and future thought and action and is, in the fullest sense of the word, a Christian Philosophy and a great one." Though the names which 124 HISTORY OF PHILOSOPHY appear in this volume are among the leading figures in European phenomenology, the content of the volume itself is somewhat disappointing. The editors note that the discussion of these papers was prolonged and lively but they regret that it was impossible to record and publish this part of the Colloquium. The reader of this volume can but share the regret of the editors in this case since many of the papers are but rough drafts, clearly meant to pose questions and lead into discussion and, of themselves, contain very little in the way of new or... The proposition that selective advantages of linguistic skills have contributed to shifts in ontogenetic landmarks of human life histories in early Homo sapiens is weakened by neglecting alternative mechanisms of life history evolution. Moreover, arguments about biological continuity through sweeping comparisons with nonhuman primates do not support various assumptions of this scenario.

The relative rate of success of parliamentary vs. governmental legislative initiative is quite different. The examination of one, resp. two full legislative term, for amendments, resp. bills introduced, shows thatparliamentary legislative initiative by far exceeds «regular» governmental initiative : in a ratio of 3 to 1 for bills, and of 4 to 1 for amendments. But the results are almost inverse : governmental initiative accounts for 76 % of the bills, and for 67 % of the amendments eventually voted. The (...) government succeeds in «pushing through» more than 90 % of its own initiatives, whereas parliamentary initiative hardly obtains an overall 10 % realization score. This article investigates the proof theory of the Quantified Argument Calculus as developed and systematically studied by Hanoch Ben-Yami [3, 4]. Ben-Yami makes use of natural deduction, we, however, have chosen a sequent calculus presentation, which allows for the proofs of a multitude of significant meta-theoretic results with minor modifications to the Gentzen’s original framework, i.e., LK. As will be made clear in course of the article LK-Quarc will enjoy cut elimination and its corollaries.

Free logics is a family of first-order logics which came about as a result of examining the existence assumptions of classical logic. What those assumptions are varies, but the central ones are that the domain of interpretation is not empty, every name denotes exactly one object in the domain and the quantifiers have existential import. Free logics usually reject the claim that names need to denote in, and of the systems considered in this paper, the positive free logic concedes that (...) some atomic formulas containing non-denoting names are true, while negative free logic rejects even the latter claim. Inclusive logics, which reject, are likewise considered. These logics have complex and varied axiomatizations and semantics, and the goal of this paper is to present an orderly examination of the various systems and their mutual relations. This is done by first offering a formalization, using sequent calculi which possess all the desired structural properties of a good proof system, including admissibility of contraction and cut, while streamlining free logics in a way no other approach has. We then present a simple and unified system of abstract semantics, which allows for a straightforward demonstration of the meta-theoretical properties, and offers insights into the relationship between different logics. The final part of this paper is dedicated to extending the system with modalities by using a labeled sequent calculus, and here we are again able to map out the different approaches and their mutual relations using the same framework. This note is a generalization and improved interpretation of the main result of Karni and Schmeidler. A decision-maker is supposed to possess a preference relation on acts and another preference relation on state-prize lotteries, both of which are assumed to satisfy the von Neumann–Morgenstern axioms. In addition, the two preference relations restricted to a state of nature are assumed to agree. We show that these axioms are necessary and sufficient for the existence of subjective expected utility over acts with state-dependent (...) utility functions and a subjective probability measure. This subjective probability measure is unique when conditioned on the set of states of nature in which not all the prizes are equally desirable. (shrink)

The Quantified argument calculus (Quarc) has received a lot of attention recently as an interesting system of quantified logic which eschews the use of variables and unrestricted quantification, but nonetheless achieves results similar to the Predicate calculus (PC) by employing quantifiers applied directly to predicates instead. Despite this noted similarity, the issue of the relationship between Quarc and PC has so far not been definitively resolved. We address this question in the present paper, and then expand upon that result. Utilizing (...) recent developments in structural proof theory, we develop a G3-style sequent calculus for Quarc and briefly demonstrate its structural properties. We put these properties to use immediately to construct direct proofs of the meta-theoretical properties of the system. We then incorporate an abstract (and, as we shall see, logical) predicate into the system in a way that preserves all the structural properties. This allows us to identify a system of Quarc which is deductively equivalent to PC, and also yields a constructive method of demonstrating the Craig interpolation theorem (which speaks in favor of the aforementioned predicate being logical). We further generalize this extension to develop a bivalent system of Quarc with defining clauses that still maintains all the desirable properties of a good proof system. (shrink)

In this article we discuss what we call the deliberative division of epistemic labor. We present evidence that the human tendency to engage in motivated reasoning in defense of our beliefs can facilitate the occurrence of divisions of epistemic labor in deliberations among people who disagree. We further present evidence that these divisions of epistemic labor tend to promote beliefs that are better supported by the evidence. We show that promotion of these epistemic benefits stands in tension with what extant (...) theories in epistemology take rationality to require in cases of disagreement. We argue that the epistemic benefits that result from the deliberative division of epistemic labor can provide epistemic reason to maintain confidence in cases of disagreement. We then show that the deliberative division of epistemic labor constitutes a distinct kind of epistemic dependence. (shrink)

Aprender Matemática na escola é deparar-se com um mundo de conceitos que envolvem leitura e compreensão, tanto da linguagem natural como da linguagem matemática. Muitas vezes, os componentes curriculares, a Língua Portuguesa e a Matemática não dialogam. A resolução de problemas parece ser um dos pontos críticos na Matemática escolar. Este artigo aproxima esses componentes de forma a buscar estratégias para uma aprendizagem efetiva.

RESUMO De acordo com Bakhtin, o dialogismo polifônico, um princípio geral para que haja um avanço de conhecimento, é bem representado no romance literário e mais comumente em narrativas, nas quais diferentes “vozes” podem ser expressas. Assim, neste artigo analisamos narrativas baseadas em imagens e construídas por trinta crianças, entre 5 e 8 anos de idade, falantes de francês, narrativas essas produzidas antes e depois de uma conversa sobre as causas dos eventos. As análises tiveram como foco a habilidade das (...) crianças de fazer diferentes vozes serem ouvidas, particularmente as vozes dos personagens, as quais as crianças fizeram ser ouvidas não apenas por meio do discurso direto e indireto, mas também por meio de expressões dos seus estados interiores, como crenças, intenções e sentimentos. Os resultados mostram tanto um desenvolvimento da habilidade das crianças de fazer com que essas vozes sejam ouvidas em suas narrativas, quanto um papel facilitador da troca conversacional em suas expressões. Argumentamos que esses resultados dão suporte para se considerar o lugar central que o diálogo ocupa no panorama geral da abordagem bakhtiniana. (shrink)

ABSTRACT For a distribution of health care resources to be fair, it should consider the consequences for the whole lives of the affected persons and not just how badly off they are at the present moment. Since, other things being equal, a person is worse off if he dies young than if he dies old, it is fair to give scarce vital health care resources to young rather than to old persons. In the paper this ageist view is restated and (...) defended against a number of objections raised by John Harris. According to Harris' so‐called anti‐ageist argument the only relevant consideration in the distribution of vital health care resources is people's desire to go on living. On reflection, this is highly counterintuitive. Instead, it is argued that both present desires to go on living and possible future happiness should weigh together with considerations of fairness. Both fairness and possible future happiness will in most cases speak in favour of saving the young before the old. A number of other problems for the ageist view are discussed, and solutions are suggested. (shrink)

In deep disagreements local disagreements are intertwined with more general basic disagreements about the relevant evidence, standards of argument or proper methods of inquiry in that domain. The paper provides a more specific conception of deep disagreement along these lines and argues that while we should generally conciliate in cases of disagreement, this is not so in deep disagreements. The paper offers a general view of disagreement, holding roughly that one should moderate one’s credence towards uncertainty in so far as (...) disagreement with others provides undefeated higher order evidence that one might have made a mistake in one’s appreciation of the first order evidence. When applying this view to deep disagreement we get that in cases of deep disagreement higher order evidence from disagreement is rebutted or undercut by the nature of the disagreement. So, in cases of deep disagreement one should not moderate one’s credence. I finally argue that this gives a better general view of deep disagreement than views appealing to epistemic peers, personal information or independence. (shrink)

On Islamic doctrine, teachings and its practice.

We sometimes disagree not only about facts, but also about how best to acquire evidence or justified beliefs within the domain of facts that we disagree about. And sometimes we have no dispute-independent ways of settling what the best ways of acquiring evidence in these domains are. Following Michael Lynch, I call this phenomenon deep disagreement. In the paper, I outline various forms of deep disagreement, following but also in certain respects revising and expanding Lynch’s exposition in (2010, 2012). As (...) is well known, for the externalist about knowledge and epistemic justification deep disagreements may be nothing more than an unfortunate failure of communication. Yet, though he grants this, Lynch argues that deep disagreement points to a sort of practical problem. I agree. In my paper I propose a revised account of the sort of practical problem that deep disagreement may pose. In short, my claim is that deep disagreement may be a problem due to the role that shared factual beliefs may have in common decision-making. I discuss and assess various reactions to the problem of deep disagreement, including the one proposed by Lynch. I argue that none of the solutions discussed in the paper are satisfactory. (shrink)

The analysis has identified the basic provisions of the fundamental principles and approaches on which the process of developing a project methodology for teaching students' conversational speech is based.
